When she was finished she said, "so Jasmine was only a few days old when she was taken in by Ms. Garcia?", Rosemary said, "that's correct mam", she the continued by telling about the will and how Jasmine was left to Penelope, along with a bank account that had been set up for the child and put into Penelope's name.
The judge/div smiled and said, "okay, let me ask you a question about Ms. Garcia", Rosemary said, "yes mam?", the judge said, "from what you said Ms. Garcia has moved from a one bedroom apartment to a beautiful house and is currently engaged to agent Derek Morgan, correct?", Rosemary said, "yes mam that's correct".
Rosemary listened as the judge said, "I assume that you've paid visits to Ms. Garcia over the past year?", she said, "I have mam, both scheduled and unscheduled and Ms. Garcia and Mr. Morgan have both passed with flying colors, everything that Jasmine needs for a stable and loving home has been graciously provided for the child".
Christopher closed his eyes and shook his head as he whispered something to his attorney who stood up and said, "I have a question for the social worker your honor", Margaret said, "go ahead", he turned to her and said, "you said Ms. Garcia and Mr. Morgan, do they live in the same house?", she said, "no sir they do not but they will when they get married in a few days".
Gretchen said, "what difference would it make if they lived in the same house or not since they are engaged to be married?", Christopher's attorney said, "my client is worried about his child being in an environment that might not be healthy for her maam".
Hotch said, "not healthy, did you and your client not hear what the social worker said, she said that my client and Mr. Morgan both passed with flying colors, that they both provided a loving and stable environment for the child, what's wrong with that?", Christopher stood up and said, "she's my daughter, mine, she belongs with me, not with this fill in mother".
Gretchen said, "sit down sir, I will not tolerate you speaking that way in this courtroom, we are not here for you to try to damage the life of or smear the character of a woman that has for the past year loved, sheltered and taken care of a child that before she had never known".
Christopher said, "I'm sorry your honor, I didn't mean anything by that comment", she said, "be seated and we will continue this hearing", he said, "yes mam" and sat back down in his seat and covered his face with his hands and started whispering to his attorney.
