This story is heavily influenced by and based on "The Trial" by Reviewgirl911. I love that fic and I wanted to give it the ending it truly deserved.

Evan Potter was in deep contemplation. It has been 3 dark and bloody years. Many had been killed and tortured. Those that had died could finally rest. In the late 1970's a dark wizard by the name of Lord Voldemort took power and used pureblood agenda to try and attempt a takeover of Wizarding Britain. Only to be stopped by one year old Evan Potter. For he was the child of prophecy. He was the one destined to defeat the Dark Lord or die trying. That's what he did. After the Dark Lord's vanquish in 1981, the wizards and witches of Britain had thought they had seen the last of the evil wizard that spilled blood just for the sake of it. Oh were are they wrong? Evan Potter was entered, unwillingly, into the Triwizard Tournament in his fourth year. He was kidnapped during the task with his competitor Cedric Diggory, by Peter Pettigrew and the powerless shadow of the Dark Lord. Cedric was killed, something that still plagued Evan, and Voldemort had used his blood in a ritual to revive himself and regain life. After dueling the recently revived Dark Lord to a stand still, Evan was able to return to the castle. Where tragedy also struck. The body of Mad-Eye Moody was found dead. Witnesses said that his murderer was the boy-who-lives older brother, Hadrian Potter. Hadrian Potter was three years older than Evan and was the quintessential child of the light. Finding out that he had turned to the dark and had joined the Death Eaters, had been hard for the Potter family. Nobody knew why he turned and he was next seen in a raid amongst the Death Eaters killing and torturing innocents. This is when the peace ended. All out war broke out within the country, and with the help of Albus Dumbledore and Evan's parents and uncle, Lily, James, and Sirius, were able to prove that he had truly returned. The Ministry prepared for war as did the Order of the Phoenix, a secret organization designed to take down the Dark Lord and his followers known as Death Eaters. The three years the war lasted had been long, tiring, and deadly. There were major losses on both sides. The dark side had lost Bellatrix Lestrange, Lucius Malfoy, Severus Snape, and Anton Dolohov. The light had lost many in return. But one loss had almost crippled the hopes and dreams of the Light. Before the end of Evan's sixth year of schooling, Death Eater's invaded the castle, Albus Dumbledore had been killed in the fight that had taken place. Not only did the shock of losing one of the greatest light wizards in recent history come as a surprise to many, it had been who had done it. Dumbledore's killer had been Severus Snape. Severus Snape was a Death Eater in the first war, but had changed sides as a spy, at the behest of Dumbledore himself.
There were many major battles that took place. One of the most famous was the Battle of Hogwarts. The students fought against the intruders with the help of the Order of Phoenix and after many successful blows to the dark, like the death of Severus Snape, Anton Dolohov and Voldemort's snake, Nagini, they retreated. Voldemort had been extremely upset at the loss. It was considered one of the few victories the light had during the war. Two days later he attacked Diagon Alley. Many lives had been lost that day.
The war officially ended with the attack on Malfoy Manor. The ward plans had been anonymously provided to the Department of Mysteries, and with a team of curse breakers, aurors, unspeakables, members of the Order of the Phoenix, and Evan Potter himself, they were able to kill or capture almost every Death Eater. In the throne room, a glorious duel took place between Lord Voldemort and Evan Potter. It was a long and strenuous battle. Those that had seen it, had seen something that no other had seen before. The Dark Lord shot a Killing curse at Evan. Instead of ducking, Evan took a chance and shot a cutting curse aimed directly at the Dark Lord's head. Both spells hit their intended target and they dropped down dead on the floor. It was silent and after a minute of panicking and worry, by the Potter family, of their youngest son, he woke up. Evan Potter survived the killing curse for the second time. Evan claimed that he had visited limbo and talked to Dumbledore. Dumbledore explained how a piece of Voldemort's soul was within him and that being hit by a killing curse separated the piece of soul. Evan returned to the land of the living. It was declared across Britain that Evan had killed Voldemort and had fulfilled the prophecy. It didn't take long for the people to celebrate that Britain was no longer at war and recovery had begun.
3 months later.
So here Evan was, Deep within the ministry lay the Wizengamot Chambers. This was where trials and court cases had been held for thousands of years. These chambers had been busy for the last two months. Over 100 Death Eaters had been captured, but this one was special. Not only because it was among one of the last, but of who was being tried. Standing accused today was Hadrian Potter.
Hadrian Potter was among one of the only inner circle Death Eaters to be captured alive. Now he was being tried for unspecified war crimes. The only thing that they were able to pin on him was the death of Alastor Moody and treason. Even though know one had truly known what he had done under Voldemort's service. He was the widely rumored Dark Lord's right hand man. Hadrian's skill with a wand was legendary and he was able to defeat wizards who had been mastering the dark arts before he was even born. Evan often wondered how much quicker the war would have been over if his brother hadn't switched sides and fought for the light.
Evan was broken from his thoughts as his mother grabbed and squeezed his hand. He looked up and saw her bright green eyes and silky red hair. Her smile comforted him, except he knew that he was anything but. His thoughts returned to his brother. If you had asked anyone what Hadrian was like when he was a kid they would have told you that he was a nice and lovely young boy. They also would have said that he loved his parents and he would have done anything for his siblings. No one knew how or why Hadrian had turned to the dark and this trial was the final piece that Evan needed to know to finally make peace with his past. Yes, he would know soon. He looked around and found comfort being around his parents and little sister. His uncle, Sirius Black being just a few seats down. The chamber doors opened and for the first time since the Battle of Hogwarts, Evan saw his brother. The two months in Azkaban, the wizarding prison, had not done his brother any good. He was being dragged by two Aurors. His bare feet sliding across the cold stone floor. He was dragged into the chamber. His green eyes that used to be full of emotion and life were now devoid of any. His hair was long and scruffy, his face unshaved. He wasn't the insane or evil looking murderer that he thought his brother had been, no he was something else. Evan glanced at him and decided that the man that was once his brother was no longer alive. That older brother he looked up to was gone. Replaced by the empty husk of a body that had been dragged in. He looked awful. Evan couldn't deny that. Soon he was thrown into an old wooden chair that rested in the middle of the chamber. Evan sat waiting nervously. He didn't want his brother to die or be in jail, but he knew that he deserved it for what he had done. The Chief Warlock, Madame Marchbanks stood and the entire room went dead silent. Not a quill could be heard dropping.
"Overseeing today's trial is Minister Amelia Bones. Prosecuting is Penelope Clearwater-Weasley and representing the defendant is" The minister paused. She took a deep breath and continued. "Da-Daphne Greengrass." And all of a sudden, Evan knew that this trial would not be as simple as he thought it would be.
