Here comes the custody battle! I'll try my best to make this an only part!

~~~~~~~~~~It's been about four days, Sam got a email from Mon-El's and setting up a court date which was what Oliver and Kara were getting ready for.

"Where are you and mama going?" Astra asked Oliver as he put their dishes in the sink.

"We have something important to do," Oliver smiled at Astra, both he and Kara decided not to tell her about the battle.

"Why can't I come?" Astra asked.

"Because," Kara came and scooped her daughter in her arms "This is a adult thing," she kissed her cheek "Plus you get to stay with Dean, Tommy, and Mia" she smiled.

"Deany?" A smile grew on Astra's face as Kara nodded "and Sammy?"

"No," Oliver shook his head "Sammy is coming with us."

"Oh..."

"I smell food" Dean walked in "Which is gone" he frowned.

"Told you" Sam smirked.

"Nuh-uh!" Astra smiled and pointed at the microwave "We saved you food!"

"You two are my favorite!" Dean beamed walking over to the microwave as Sam's smile dropped.

"We saved you some to Sammy" Astra said.

"I'm okay pumpkin," Sam smiled "Dean can have mine" he chuckled as Dean did a little fist pump.

"We should get going now" Sam looked at Oliver and Kara who nodded.

Both giving their daughter a kiss goodbye telling Dean that the others were still sleep then left.

Everyone was in the court room, Alex, J'onn, Winn, William, Evelyn, and Nia, on Kara and Oliver's side as the two were going over their plan with Sam, other the other side was Mon-El and his lawyer while his team and Imra was behind him.

Kara could feel Mon-El staring at her, she moved uncomfortably under Oliver's arms, he and Sam looked at her asking if she was okay, she just nodded telling them she a fine.

Soon the judge walked in picking up the papers as everyone sat down in their seats.

"Mike Matthews vs. Kara and Oliver Queen," she reads papers "Mr. Matthews it's saying you're suing your ex for custody of your five year old daughter," Mon-El nodded "Why?"

"Your honor, my client has been denied to see his daughter for five years! She was taken away from her father with the mother leaving while pregnant!" Mon-Els lawyer said, "and once he found his daughter Mrs. Queen's fiancé at the time threaten him to not come nearhisdaughter!"

People on Kara's side gasp, Kara hand to hold Oliver's hand stop him from going after Mon-El.

"Mrs. Queen is this true?" The judge looked over at Kara.

"No ma'am," Kara shook her head "It was Mike who left me after cheating, I had no one to help me besides my sister and friends who were busy with their own lives and Oliver took me in," Kara said "Then five years later he comes back wanting to see my daughter."

The judge nodded "It says here you tried to allow him to visit but made him stop?"

"Your honor, the night that man showed up on the Queen's door step he was drunk, and was demanding to see Astra!" Sam stood up "My clients made a deal with Mr. Matthews and kept their part but he did not" he added.

"And what was this deal?"

"He's allowed to see her if he doesn't screw up, and he did so by showing up drunk on their doorstep."

"Your honor," Mon-El's lawyer jumped up "If you read the papers it would say that Mr. Queen assaulted my client in his own home when he and Agent Danvers showed up to 'talk'..." Alex sank in her seat as Oliver just glared at Mon-El "Does that sound like a safe environment for a five year old?" his lawyer questioned.

"Your honor, I would like to call a someone to the stand!" Sam immediately said.

"I wasn't aware we were doing that" Mon-El stated.

"Well there are some people who have a lot to say about you" Oliver said.

"You may Mr. Winchester" the judge nodded.

"I would like to call Alex Danvers to the stand" Sam pointed at Alex who stood up.

"Can we go to the park?" Astra asked Dean and Mia.

"We would love to but Tommy is still sleep and we don't want to wake him up" Mia said. Astra pouted and nobody liked it when this little girl had a frown on her face.

"Why don't I take her to the park and you stay here with Tommy" Dean offered.

"Uh okay," Mia nodded and Astra beamed.

After Alex got off the stand the judge called a break giving her time to decide everything.

Oliver and Kara sat in a room with Sam, "So just because I threatened him it's an unsafe environment for Astra?" Oliver asked.

"Oliver you didn't just threaten him," Sam sighed "You beat his ass!"

"And I'll do it again!"

"No the hell you won't!" Kara slapped her husband's arm.

"He claims that your anger issues is unsafe and you will hurt your family."

"I would never!" Oliver exclaimed.

"We know that but the judge doesn't," Sam sighed "But we might have a shot because he stepped out before Astra was even born and Oliver's name being on the birth certificate" he added.

"So what does that mean?" Kara asked "Full custody or share custody?"

"It means you could possibly get full custody and control whenever he sees Astra or yeah share custody" Sam said and the couple let out a sigh.

"So how are you enjoying your summer break?" Dean asked Astra, they had gotten some ice cream, well Astra got ice cream and Dean got pie, before going to the park.

"It's fun!" Astra smiled "But a
I haven't been able to spend time with mama and daddy though" she frowned slightly.

"Why not?"

"They've been busy with adult stuff like work and super stuff" Astra said.

"I'm sure they're going to spend all their time with you after this adult stuff," Dean said.

The two finished up their sweets and made their way to the park.

Everyone was now back in the court room on their respective sides, Kara's played nervously in her hands.

"When it comes to custody of five year old Astra Danvers, you will share 50/50 custody, Mr. Matthews having the weekends and Mr and Mrs. Queen having the weekdays and holidays will be split," she declares "and if either of you step out of line the other parent will get full custody!" she banged her gavel on the stand and walked out.

The Sam gathered everything up as Kara and Oliver stood up, they were happy they got to keep Astra but disappointed that it was 50/50 custody.

Kara and Oliver returned home William and Evelyn walking in behind them with Sam still in the car, "Hey guys" Mia said noticing her family walking in "How did it go?"

"We have to share custody" Oliver said "Were is Astra?" he asked as Kara went to pick up Tommy.

"She taking a nap."

"Oh Dean, Sam said you two got a case" William said.

"Well we'll see you!" Dean waved goodbye before leaving.
