A/N: This was a request from HMG2000 and takes place during Yates' trial in "Daydream Believer" (SVU Season 16 Episode 20). I don't own any of the characters except my own.
Finding Out This Way
Olivia was uncomfortable with Yates questioning her. She had been through this before with William Lewis and she hated it then too. He had been trying to put the blame on someone other than himself and right now, that was Jay's brother, Will. Things were about to get worse. As Yates stood in front of her, he closed his eyes and sniffed.
"You're pregnant, aren't you, Sergeant Benson?"
"Excuse me?"
"You're pregnant. I can tell a woman is pregnant by her smell."
"Objection! Relevance."
"Sustained. The Jury will disregard. Dr. Yates, please stick to the case."
Yates continued his line of questioning but he was right. She was pregnant but that was not how she had planned to tell Hank. They were trying to keep their relationship under wraps for the time being. She could not look at Hank without wanting to cry and she wanted to get out of there as quickly as possible. As soon as Yates was done with his harassment of her and Judge Barth excused her, she headed out of the Courtroom. She needed to be alone. She headed home and Lucy and Noah weren't there when she got there. She changed out of her work clothes and into something more comfortable. She then rested on the sofa.
After Court was adjourned for the day, Judge Barth wanted to meet with Counsel on both sides in her chambers. Hank knew he needed to talk to Olivia, they all headed back to the Precinct but Olivia was nowhere to be seen. He headed to her apartment and went upstairs. He then knocked on the door. Olivia got up and looked to see who it was.
"Come in."
"Thanks."
Hank came in and they sat down.
"Hank, I am so sorry. That wasn't how I had planned to have you find out. I wanted to do it over dinner or something more romantic."
"I'm not mad. So, he was actually right about something?"
"Yes. It happened around New Year's. A part of me wasn't sure how to tell you because we're still trying to figure out what this is between us. I don't want to raise him or her in two different cities."
"I get it. We'll figure it out. How long have you known?"
"I found out just before I came to Chicago. I didn't want to bring it up because we're trying to keep our relationship under wraps and we're trying to keep our personal relationship separate from our professional relationship. I probably would have told you after the trial was over. He threw me for a loop when he just blurted it out the way he did."
"I can imagine because I felt the same way. I want you to know that I love you and I will do anything to make this work."
"I love you too."
Hank kissed Olivia and wrapped his arms around her. He also put his hand on her belly.
"I'd be willing to leave Chicago."
"You would?"
"Yeah. I know if I get a job here, I'll need to behave myself."
"I can tell you that Tucker has to have everything done by the book."
"Internal Affairs?"
"Yep. I'll look to see if there are any openings anywhere here if that's what you want."
"It's what I want. I don't want to be a part-time dad to my kid and like you said, you don't want to be trying to co-parent in two different cities. I guess it's up to you if you want to get married."
"Actually, I would like to get married."
"Justin thought you were great and would be a good match for me."
"I thought he was great too. When is the baby due?"
"Towards the end of May. Erin and I are planning to go down, so if you and Noah want to join us, you're more than welcome too."
"I will take that into consideration."
"Ok. By the way, why are you still out in the field and not on desk duty?"
"If I go on desk duty, then I need to tell people. I wanted you to know first. Now they're going to start asking. I know you probably need to be around for Erin."
"I do but you're more important."
"I'm due at the end of September or the beginning of October."
They started kissing and then there was a knock at the door.
"Let me guess, my squad, Barba and Erin and Jay."
Olivia got up and looked to see who it was.
"Yep."
She opened the door.
"So, was there any truth to what Yates said?"
"Hello to you too, Fin. Come on in."
The 7 of them came in and found a place to sit. Olivia sat back down next to Hank.
"Should we assume that if there's any truth to this, Voight is the father?"
"That would be a good assumption."
"How long have the two of you been a thing?"
"Since after that first case we worked on together. There is truth to what Yates said. This isn't how I wanted Hank to find out though."
"Yates is a damn creep!"
"Are you leaving Chicago?"
"More than likely. I don't want to be a part-time dad to my kid nor do we want to co-parent this kid in two different cities."
"That is understandable."
"Liv, we'll do what we can to help you out more, so you're not gettin' too stressed out."
"Ok, thanks. I appreciate that. I wouldn't be opposed to going to Chicago but I'm not sure I want to transfer out there. I'm hoping to adopt Noah soon."
"For what it's worth, we would love to have you for our boss."
"Thanks a lot, Erin. I'll remember that the next time you want something."
"I appreciate that, Erin but I think if I was to come to Chicago, I'd want to be a stay at home mom."
"Hank, you should be a stay at home dad."
"I'm not ready for that yet."
"I'm not sure I'm ready to retire either. Like I said, I'll check around and see what's available."
"I appreciate that."
"When is the baby due?"
"End of September or the beginning of October. It happened around New Year's."
"Has Justin met her?"
"Yeah, he has and he seems to like her. I invited her and Noah to come with us when we go down to meet the baby."
"Ok."
"Rafa, whatever happens, I want that son of a bitch to go down."
"He will. I'll make sure the Jury sees him for who he really is. Judge Barth was not happy for how he was acting in court today. She met with Ms. Crane and myself after we were adjourned for the day. She told her that if Yates pulls anything like what he pulled with you throughout the remainder of the trial, she will hold him in contempt. Ms. Crane said she would talk to him."
Lucy came back with Noah. Lucy left and then they decided to order dinner. Hank had gone to check out of his hotel room and brought his stuff over to Olivia's. After everyone left and she and Hank put Noah to bed together, they made love before falling asleep in each other's arms.
The next day, they were back in court but now Yates was saying Hank forced himself on Nadia. Olivia could tell Hank was pissed but she couldn't blame him. She was pissed too. She knew Hank wasn't capable of that. She knew what he was like in the bedroom and she also knew how much he cared for Nadia. Rafael looked back at Olivia and Hank and Olivia nodded at him. Once Yates had looked at the autopsy photos with Melinda back on the stand, Rafael knew this was where he would start to show his true self. He was right. The Jury found Yates guilty and Judge Barth told him he would be held until sentencing. Rafael went back to his office and Amanda went home to Frannie, while everyone else went to a bar to celebrate the big win. Olivia had ginger ale, while everyone else had something else.
"Nadia was family."
"To Nadia."
"To Nadia."
Everyone clinked their glasses in their toast to Nadia. Once they left the bar, Olivia was heading home to relieve Lucy. Hank told her he wanted to clear his head. He walked and ended up back where Yates was being held. Hank was angry about what Yates had said about him in court, so he went to "talk" to him, which resulted in Hank holding him against the wall with his hand near his throat. He told him someone would do to him what he did to Nadia. He left and headed back to Olivia's after he made one more stop. When he arrived, he knocked on the door.
"You went to see Yates, didn't you?"
"I told him someone would do to him what he did to Nadia as I held my hand near his throat."
"I figured you weren't going to let that go but I'm glad you told me."
"Are you planning to arrest me?"
"No. He deserved it. I don't want any secrets between us though."
"I don't either. Let's go sit."
"Ok."
The two of them went over to the sofa and sat down. Noah was playing with his blocks on the floor. Hank took something out of his pocket.
"Olivia Benson, will you marry me?"
"Yes!"
Hank took the ring out of the box and slipped it onto her finger.
"Hank, it's beautiful."
"I'm glad you like it. It fits ok?"
"It does. I love you so much."
"I love you too."
They kissed and then he put his hand on her belly.
"Would you be interested in adopting Noah with me when the time comes?"
"Yeah, I would."
Hank got up and went to pick up Noah.
"I would love nothing more than to be a dad to this little guy."
Noah gave Hank a shy smile and then he hugged him.
"We should look for a bigger place too."
"We can do that."
"Since I am actually in the office tomorrow, I will ask around for any open positions."
"Ok. I'm probably headin' back to Chicago with Lindsay and Halstead tomorrow afternoon, since I need to deal with the rest of the squad with what happened."
"Of course. I'll let you know what I find out."
They started kissing and then there was a knock at the door, so Olivia went to see who it was. It was Tucker.
"What's going on, Tucker?"
"I just wanted to see how things went with the Yates' trial."
"Come on in."
"Thanks."
Ed walked in.
"Ed, this is Sergeant Hank Voight from CPD. He heads the Intelligence Unit. Hank, this is Lieutenant Ed Tucker from Internal Affairs."
"Nice to meet you."
"You too."
They told Ed what happened during the trial.
"I'm glad you got the conviction."
"We are too. I need to talk to you about a couple things."
"Ok."
"I need to go on desk duty until September or October."
"Everything ok?"
"Yeah. I'm pregnant."
"Wow! Congratulations to you both. I kind of figured you were with someone, since you pretty much indicated you weren't interested in even getting a drink with me. He's the one you compared to Stabler, right?"
"Yes but he's been better. I admit, you've been better lately too but I didn't want to give you the wrong impression."
"Other than Amaro lately, I don't have problems with SVU."
"Amaro turned out to be a better guy than Elliot. I've had Don Cragen tell me that I have really proven myself and came into my own since Elliot left. I have a better relationship with Trevor Langan but he is helping me with the adoption. My opinion of him changed when he represented me when you arrested me for that VanDyne guy's murder."
"I've even noticed that you've come into your own since Stabler left. I think he was holdin' you back."
"Coming from you, that's a compliment. Cragen said he thought Elliot was holding me back too. Fin always has to voice his opinion on the subject. He wasn't a fan of his."
"Me neither."
"Obviously."
"What else do you need, Sergeant?"
"Do you know of any openings anywhere? Hank wants to transfer here."
"I think there is an opening to run Organized Crime but I will check for sure. Would you consider takin' the Lieutenant's exam?"
"Me or her?"
"Both. NYPD Brass claims they don't want a Sergeant runnin' SVU."
"I guess if she takes it, I will. Maybe I'll see if they're doin' one in Chicago anytime soon."
"That works too. All I ask is that you try to play stuff by the book."
"I've been trying to be better for Olivia. I did threaten Yates though."
"He deserved it from what I could tell."
"Can I use your laptop?"
"Sure."
Hank opened Olivia's laptop and logged into the CPD site. He then looked to see if there was anything available for the Lieutenant's exam. He found that they were giving it in a couple weeks, so he signed up for it.
"There's one in a couple weeks, so I signed up for it."
"Good. Ours is around that time too. Can I sign you up for it?"
"Oh, sure."
"Ok. Think about who you want as your #2."
"Probably Fin but I'll talk to him. We've got Johnny D's trial coming up soon."
"Does your squad know about that yet?"
"No but I will need to talk to them about it. I haven't even talked to Langan about it and he's the lawyer working with me on the adoption. It has nothing to do with me wanting to adopt Noah. I just want that SOB off the streets."
"I get it. When do you go back to Chicago?"
"Tomorrow afternoon. I need to deal with finalizing all the stuff with Nadia and let my squad know that I am planning to leave Chicago."
"Who takes over?"
"Probably Antonio."
"That makes sense. Maybe you could talk Al into coming with you."
"I'm not sure how thrilled Meredith would be with that though."
"How old is their daughter?"
"17."
"Justin is how old?"
"He is 22. He and Lexi were pretty close growing up."
"Is he in college?"
"No. He spent some time in jail for a DUI and once he got out, he kept gettin' into trouble. I drove him to the Army Recruitment office and told him I'd see him in 4 years. His girlfriend showed up on my doorstep and told me she was pregnant with his kid. My first grandchild, a boy, will be born in a few weeks."
"Congratulations!"
"Thanks."
"Hopefully he'll be close to his aunt or uncle."
"I hope so. Justin seems to be trying to get his act together. He wants to be a good dad to his kid. I want to be a better dad to both Noah and this kid than I was to Justin. We never had that great of a relationship anyway but it got worse after Camille's death."
"How long has she been gone?"
"5 years. She had ovarian cancer. There's nothing worse than seeing the person you love the most just wasting away. I was a mess after she died. A part of me didn't think I wanted that again but then I met Olivia."
"I think I started seeing Olivia differently after what she has been through with William Lewis."
"I knew you had a heart in there somewhere. You just don't want anyone to see it."
"That sounds about right. I should go. I will check into the openings and let Olivia know."
"Ok. Thanks."
"No problem. Nice meetin' you."
"You too."
Ed shook Hank's hand and then he left. Olivia then went to lock the door.
"He didn't seem so bad."
"He's gotten better in the last few months but it really makes me wonder what he's up to."
"He asked you out for a drink?"
"He did but I said no. That would be weird."
"You talk about your former partner a lot."
"We were close because we worked together but he had a huge ego and made everything about himself. There were people, including his wife, who assumed there was more to our relationship but there wasn't. I would never want to be the reason someone's marriage ended. Yes, I cared for him but I never wanted to be with him in that way. I have you now and that's all I care about."
Hank kissed Olivia.
"Dada."
"Did he just call me Dada?"
"That's what it sounds like."
"I hope to be your daddy soon."
"And I hope to be your mama."
They both kissed Noah on his cheeks and then Olivia ordered Chinese for dinner. They put Noah to bed and enjoyed the rest of their night together mostly making love. The next morning, Olivia got up to get ready for work, while Hank got up to fix breakfast. He heard Noah up, so he went to get him and changed his diaper. He put him in his high chair while he made breakfast for Olivia. By the time she was out of the shower, dressed and had her hair dried, breakfast was ready and Lucy was there. They ate and told Lucy about then being engaged and expecting a baby. Olivia said she hoped she would continue to work for them and take care of both kids. Lucy said she would. Olivia left for work after she kissed her boys and told Hank to let her know when he got home. Hank went to take a shower, while Lucy went to get Noah cleaned up and dressed. After Hank was done in the shower and dressed, he got his stuff together.
Ed had confirmed to Olivia that Organized Crime was looking for someone to run the unit and asked if Hank could interview before he went back to Chicago. She said she would call him. She knew his flight was around 3 o'clock. She called Hank and told him. He said he didn't have a problem with it. She said to meet her at the Precinct and she would take him to where he needed to go. He kissed Noah goodbye and headed to the Precinct. When he got there, everyone was at their desks.
"Hey."
"Hey, Voight. Congratulations on the engagement."
"Thanks."
Olivia came out of her office and then they left. Olivia stayed there while Hank was having his interview. She had seen Chief Dodds, so she told him what was going on. Once Hank was done, they left and Hank took her out to lunch before he took her back to the Precinct. He told her he'd be back as soon as he could. She kissed him before she got out of the car and went to get Erin and Jay at the hotel. They headed to the airport and once they got checked in, they went through security and headed to the gate. Hank texted Justin and asked him to call him later that night when he had time. Erin had gone to the washroom.
"How's she doin, Halstead?"
"She's havin' a hard time and it's been rough on all of us."
"It has. I interviewed for a position with the NYPD this morning. I'm comin' here whether I get it or not."
"That makes sense. You need to be where your kid is."
"Yeah. I have this feeling that Erin is headed down the wrong path. I need you to keep a close eye on her for me."
"You don't even have to ask. You know as well as I do that she's very strong-willed and does what she wants anyway."
"Oh, yeah. I do know that. I'm glad she's as close as she is to Olivia because let's face it, she needs a strong female influence in her life and that's not Bunny. Bunny is always saying that I'm gonna get Erin killed. It was Erin's choice to be a cop."
"Bunny likes to party, doesn't she?"
"Yeah and she's always been into drugs, which is how Erin basically ended up with me and Teddy ended up here doin' what he's doin'. It seemed like he didn't want to straighten his life up and I know Erin offered to help him."
"You can't help everyone. You know that and she knows that."
"Yeah, I know. I went to see Yates after we left the bar. I told him that someone would do to him what he did to Nadia."
"Does Sergeant Benson know about this?"
"Yeah, I told her. The guy from Internal Affairs showed up at her apartment and wanted to know how things went. He's the one that got me the interview with Organized Crime."
"Running it?"
"Yeah. It's pretty similar to what I'm doin' now. Olivia said I should bring Olinsky with me. I told her I wasn't sure Meredith would like that."
"Ruzek would be devastated. He looks at Olinsky like another dad. I know we haven't always seen eye to eye but we can agree that we both care for Erin."
"You're right about that. We do."
Then Erin came back.
"I think I want to transfer here."
"What about us?"
"We'll figure something out. You can come here too then."
"What would you be doin'?"
"I wanna work in Liv's unit."
"Then it'll be up to you to talk to her."
"I know."
A little while later, they boarded the flight for Chicago and a few hours after that, they arrived home. When they got their luggage, they headed straight for the District. Trudy was in her usual spot. The mood at the 21st was somber to say the least.
"Trudy, I need you upstairs."
"Sure."
Hank, Erin and Jay headed upstairs and Trudy was right behind them.
"I need to go to the Ivory Tower yet but I'm leavin' Chicago for New York. I interviewed for a position to run the Organized Crime Unit but I am goin' to New York whether I get the position or not. Olivia and I are havin' a baby and are plannin' to get married. I need to be where she is. Erin has expressed interest in wantin' to join Olivia's unit but has not talked to her yet. She may be leavin' as well. Dawson, the unit will be yours to run."
"Ok."
"What about Halstead?"
"It's up to him to him to get a job there if that's what he chooses to do."
"If I decided to go to New York, could I join your new unit?"
"Maybe."
Erin called Olivia and told her that she was interested in joining SVU if they had room for her. She told her to come back with Hank and she would get her an interview. Hank had gone into his office and Al followed him. They shut the door.
"So, you're really leavin'?
"Yeah. I don't have a choice."
"I know you love her."
"Yeah, I do. We don't wanna be co-parenting our kid in two different cities. Olivia said I should bring you with me. I said I didn't think Meredith would be too thrilled with that. Honestly, I'd rather have you than Halstead. A part of me hopes this relationship between Lindsay and Halstead doesn't last."
"Maybe she'll talk him out of it."
"That's what I'm hopin' for."
Then there was a knock at the door.
"Yeah."
The door opened and Erin came in.
"Liv said I could come back with you and I could get an interview. I think I wanna convince Jay not to come with me. I think we need some time apart."
"That's up to you. I'm goin' back early next week."
"That's what she said."
Trudy and Hank worked on getting Nadia added to the memorial at the District. It took some work but they were able to get it done. Erin had also found out that Nadia had been accepted to the Police Academy. Erin kept her distance from Jay and of course Jay blamed it on Hank. Hank told him that Erin is capable of making her own decisions.
By the time Hank and Erin went back to New York, Hank had heard that he had gotten the position to run the Organized Crime Unit. He and Olivia went looking at places and Erin talked to Chief Dodds about joining SVU. Olivia was fine with it but she still had to talk to the Chief. By the time, Hank and Erin went back to Chicago, he and Olivia had made an offer on a place and it had been accepted.
Once Hank got back from New York, Hank had taken the Lieutenant's exam. Olivia had taken it as well.
A month later, they had closed on their new place and Hank was moved to New York. Erin had cut Bunny out of her life completely, which of course Bunny blamed on Hank and Jay had decided to stay in Chicago.
At Olivia's appointment shortly after Hank moved to New York, they found out they were having a girl. Olivia was trying to stay calm for their daughter but the stress of the Johnny D case was starting to get to her. She and Hank had been approved to adopt Noah but then Johnny and his lawyer were trying to stop it from happening. During the trial, Johnny had shot and killed a court officer, injured another court officer and injured Judge Barth before being shot and killed by Amaro. Nick had been shot in the abdomen and the knee, which forced him into early retirement. He had decided to move to California to be closer to both Zara and Gil. Hank and Olivia went to Judge Linden's office with Trevor and Erin and officially became Noah's parents. She had said she could also marry them but they wanted his son there and since Olive had just had the baby, they wanted to hold off. They had a party with Olivia's squad and friends after the adoption. They took a few days and went to meet the newest member of the Voight Family. Justin, Olive and Olivia got to know each other better.
A month later, Justin, Olive and Daniel had come to New York, so Hank and Olivia could get married. Hank's former squad, except for Jay, had come in for the party they were having and everyone was able to celebrate with them. The two of them went on a honeymoon, while Erin and Lucy took care of Noah.
During the next few months, Hank finished the nursery and Amanda, Erin, Melinda, Trudy and Kim had a baby shower for Olivia. At the beginning of October, Olivia gave birth to Avery Olivia. Amanda had found out she was pregnant and told Olivia before she told anyone else, since she would have to be on desk duty. Chief Dodds' son was now the new Sergeant for SVU, since Fin had said he didn't want it. It had taken a while but Olivia and the rest of the squad had grown to trust him. Olivia had been planning to take at least 6 weeks off to care for their newborn daughter and their son. It was a little overwhelming for Noah at first but he grew to love his new baby sister.
In the almost year and a half, Olivia had become the mother of two children and a wife. She was more in love with her husband and children every day. She and Justin had become close a well and she loved being a grandma to Daniel. She was grateful and very blessed that Avery was healthy and Noah had seemed to grow out of his respiratory problems that had plagued him early in their life together. Hank was already spoiling their daughter rotten but then again, he had been spoiling Olivia during her pregnancy and there was nothing he wouldn't do for Noah. Justin loved being a big brother to both Noah and Avery and Noah loved Justin as much as he loved Hank.
